This role sits within LBC Capital, a subsidiary of Laurentian Bank.
Acting as legal advisor within the legal department of LBC Capital, the equipment financing subsidiary of Laurentian Bank.
The legal advisor will generally act as a reference for all legal aspects of LBC Capital's business. In collaboration with his manager, the Head Legal and Compliance and his colleagues, the incumbent will answer the various legal questions of the business line and will participate in the development of procedures and document templates.
The incumbent will also be called upon to work in collaboration with the collections department. At all times, the incumbent must ensure compliance with regulatory procedures and requirements while contributing to the optimal functioning of operations and the achievement of business line objectives.
Responsibilities
- Respond to the various legal questions asked by employees and find effective solutions while protecting the interests of the business line.
- Advise account executives on the various legal aspects of transactions.
- Rule on the validity and enforceability of security in financing files.
- Draft, review and negotiate various equipment financing contracts, credit agreements, master assignment and service agreements, as well as security documents in accordance with LBC Capital policies and credit approvals.
- Analyze regulatory compliance requirements (RPCFAT FATCA, personal information, etc.).
- Support the collections department with the legal aspects related more complex files.
- Coordinate litigation files with external counsels.
Qualifications
- Bachelor of Law degree.
- Member of the Bar Society of a Canadian Province or Quebec Notary.
- Knowledge of the law applicable to commercial financing, security and equipment financing.
- Knowledge of civil law and common law knowledge (an asset).
- Ability to communicate effectively, both orally and in writing, in French and English*
- Ability to evolve in a dynamic environment and manage multiple files at once.
- Excellent organizational skills, effective management of priorities and attention to detail.
- Excellent business sense.
- Positive, upbeat attitude. Willingness to learn and roll up sleeves (no job too big, no job too small).
- Relevant experience acquired in a law firm or within a financial institution (an asset).
- Professional working proficiency in French and English languages required as position involves frequent written and oral communication on complex matters with internal and external parties in both languages.
