The Ontario Securities Commission (OSC) is the statutory body responsible for regulating Ontario’s capital markets in accordance with the mandate established in the provincial Securities Act and the Commodity Futures Act.

The mandate of the OSC is to provide protection to investors from unfair, improper or fraudulent practices, to foster fair, efficient and competitive capital markets and confidence in the capital markets, to foster capital formation, and to contribute to the stability of the financial system and the reduction of systemic risk.

This mandate is performed through policy, operational, adjudication and enforcement work. The OSC also contributes to national and global securities regulation development.

The Enforcement Branch supports the OSC in delivering fair, vigorous and timely enforcement. The Enforcement Branch investigates and litigates breaches of securities laws in Ontario.

Team members work closely with other securities regulators, self-regulatory organizations and law-enforcement agencies to enhance initiatives to fight misconduct.

A strong enforcement presence assists in protecting investors from unfair, improper or fraudulent practices and fostering fair and efficient markets.

The Enforcement Branch is looking for a Senior Forensic Accountant to join the Office of the Whistleblower (OWB) toassist in administering the OSC Whistleblower Program (Program).

The Programis the first whistleblower program by a Canadian securities regulator that pays awards of up to $5 million for tips that lead to impactful enforcement action.

OWB is a unit within the OSC’s Enforcement Branch that is made up of a specialized team of accountants, lawyers and professional support staff.

The Office is focused on supporting whistleblowers in coming forward and reporting misconduct; working with Enforcement Branch teams to advance investigations and Enforcement proceedings;

and developing and promoting the Whistleblower Program as a critical tool that gives voice to whistleblowers to protect investors and hold those who would harm them, accountable.

The role will also support other team members in advancing the additional team mandates of promoting interregulatory cooperation and other initiatives to disrupt misconduct.

What will you do?

Apply investigative and accounting knowledge and experience to obtain, review and analyze whistleblower submissions, including related documentary and testimonial evidence;

identify issues, potential breaches of Ontario securities law and make recommendations on whether these submissions warrant further review, investigation or alternative resolution

Manage and scrupulously guard highly sensitive and confidential whistleblower information and evidence

Be able to work independently, and alsolead a multi-disciplinary team, to establish priorities, identify critical tasks and advance files and projects in a timely manner to achieve specific objectives

Act as a resource for other staff members by providing broader accounting and forensic accounting expertise on other files as required

Communicate with and support whistleblowers and / or their counsel regarding submissions, Enforcement investigations, and Commission proceedings

Work collaboratively and support investigation and litigation teams and other OSC Staff to further review, investigate and litigate matters involving whistleblower submissions

Work collaboratively with whistleblowers and / or their counsel, investigation teams and other stakeholders in administering the whistleblower award determination process

Engage with external stakeholders, including capital market participants, whose activities and interests intersect with the Program

Identify and resolve complex issues that impact whistleblowers and other stakeholders related to investigations and proceedings involving whistleblower tips

Proactively develop and promote the Program internally by developing and implementing internal processes, controls and programmatic improvements while fostering key relationships;

andexternally through outreach and consultations with stakeholders, including delivering public presentations and engaging in other creative efforts to raise awareness of the Program

What do you need to be successful in this role?

An undergraduate degree and prescribed course content required for Chartered Professional Accountant (CPA) exams

Membership in good standing with CPA Ontario or equivalent designation in another jurisdiction

Your Master of Forensic Accounting (MFAcc), Certified in Financial Forensics (CFF), Certified Fraud Examiner (CFE), or equivalent experience would be an asset

8 to 10 years of relevant forensic accounting experience as a qualified CPA

Experience dealing with IFRS matters, financial reporting and disclosure obligations of public companies and / or registrant obligations under Ontario securities law is an asset

Experience with fraud investigations, forensic accounting and business valuations in the context of the capital markets is an asset

Strong interpersonal, communication (verbal and written) and public speaking skills, with demonstrated ability to establish collaborative working relationships and engage with internal and external stakeholders

Ability to work independently and perform a leadership role in organizing and managing multiple, complex projects and priorities

Demonstrated ability to analyze complex and novel issues, engage in strategic thinking to develop creative recommendations

Detail-oriented self-starter who takes great pride in delivery high-quality, timely results
