About the role
We’re looking for an In-House Legal Counsel to join our growing team!
What you’ll do here :
Responsible for providing legal representation to the claims department and its insureds on Property and Casualty litigation files.
Responsible for handling insurance defence files from beginning to conclusion.
Prepares and delivers initial report providing recommendations on liability, quantum assessment and file management strategy.
Advises client on need for further investigation. Advises client on creative and pro-active options intended to achieve earlier file resolution.
Uses civil procedure rules to compel plaintiff document production and early discovery dates. Drafts opinions, pleadings, affidavits and other documents supporting motions applications, mediation briefs and pre-trial memoranda.
Prepares and conducts applications / motions, discoveries, mediations, arbitrations, pre-trial conferences and trials.
Researches and advises client on issues impacting on claim. Reports to client following discovery examinations or on receipt of information impacting on quantum assessment or early file resolution.
Advises client on developing trends in law.
Negotiates settlement with opposing counsel. Provides verbal and written opinions on insurance policy interpretation and coverage issues.
Prepares and presents educational seminars to claims department. Maintains productive communications with claims department and individual adjusters.
Works as part of the Litigation Department team to implement programs and procedures to achieve cost-efficient and quality legal services.
Handle insurance litigation files of varying complexities from beginning to conclusion.
Draft opinions, pleadings, affidavits and other legal documents to support applications, mediations, judicial settlement conferences and trials.
Independently prepare and conduct applications, discoveries, mediations, arbitration, pre-trial conferences and trials.
Prepare and present legal educational seminars to the claims department and help your Intact colleagues from other departments on inquiries.
Maintain productive and effective communications with claims department and adjusters.
What you bring to the table :
Member in good standing of the Law Society.
Minimum of 2 years of insurance litigation; but open to various levels of experience.
Experience in legal research and writing, including authorship of legal opinions.
Experience in drafting pleadings, conducting discoveries, mediations, application documents and pre-hearing memoranda.
Proficiency in alternative dispute resolution (ADR) processes.
Trial experience, particularly independent trial experience, is a definite asset.
Excellent verbal and written communication skills, combined with research and negotiation experience.
Have superior organizational skills, including the ability to handle multiple case files simultaneously.
Have strong interpersonal skills and the ability to build effective client relationships.
Must be Bilingual (English / French) - fluent in both verbal and written
No Canadian work experience required however must be eligible to work in Canada
