WORK ILLUSTRATION :
Responsible for providing expert legal litigation advice and opinions to Toronto Hydro management on potential or actual claims made against the organization, operational items of material risk and compliance issues, representing the organization before court and tribunals (as required) and managing the work of internal and external counsel in litigation matters.
The incumbent manages and executes the end-to-end litigation management systems and process, to mitigate and resolve litigation and privacy risks for the organization.
They provide litigation support and expert advice and guidance to regulatory applications, complex legal projects, and is the main point of contact for privacy matters, in collaboration with the Chief Privacy Officer.
The incumbent is expected to behave ethically and follow the established code of business conduct, policies and internal control procedures, laws and regulations governing Toronto Hydro.
KEY RESPONSIBILITIES :
- Manages the litigation management system and processes from end-to-end to develop and prepare litigation strategies to represent the organization before courts, boards and tribunals.
- Leads a team of legal professionals and administrators to manage complex facts and legal issues and to defend the company from significant litigation matters pursued against it, including the oversight of creation of documentation to support litigation files.
- Guides the company on privacy matters and supports requirements of the Chief
Privacy Officer on how the organization collects, use and discloses information.
- Addresses the litigation risk to the organization to ensure corporate compliance with all applicable privacy laws, as well as non-legal guidelines and standards.
- Works collaboratively with internal and external stakeholders, prepares and delivers practical and accurate legal opinions, advice, consultation, interpretations on litigation and privacy matters, legislation, case law, organizational business unit issues and other legal matters to the organization based upon expertly prepared research, including acting as a leading participant in key inter-departmental task forces.
- Oversees privacy investigations and ensures appropriate notification and reporting obligations of alleged privacy breaches to ensure compliance with privacy laws.
- Leads response to MFIPPA requests, excluding employee / labour relations matters.
- Continuously improves legal processes and services to achieve cost and time savings for the organization.
- Researches and reviews best practices (based on evolving legislative and regulatory landscape) to augment current litigation and privacy management and technology systems.
Refines communication strategies to ensure effective communication at all stages of the litigation process.
- Manages the alignment of litigation strategies, business planning systems and activities.
- Develops and utilizes strategies to avoid legal risk.
- Builds and manages relationships with external legal counsel, providing direction to implement the organization’s litigation strategy.
- Ensures the timely resolution of conflicts / complaints, and responses to inquiries and requests from regulators are addressed promptly.
- Provides input to the Director to support litigation and privacy strategy development and business plans.
REQUIREMENTS :
- Undergraduate degree along with a Bachelor of Laws (LL.B) or Juris Doctor (J.D.) from a recognized Law School.
- A member in good standing with the Law Society of Ontario.
- Five (5) to seven (7) years of litigation experience, including : experience in civil, administrative and / or quasi-criminal litigation;
and as a representative before the courts in corporate matters.
- Practical work experience in the privacy field, preferred.
- Superior knowledge of legislation and common law impacting the organization.
- Knowledge of legal issues around organization liability.
- Ability to manage a portfolio of litigation files.
- Strong communication skills (oral, written, presentation, facilitation and active listening).
- Proven judgment and decision-making skills.
- Strong negotiation skills and the ability to influence others.
- Proven analytical, communication, negotiating, and leadership skills.
- Demonstrated ability to receive and effectively digest complex information in a high paced environment.
Toronto Hydro has introduced a Hybrid Work Arrangement. This position allows for remote work up to three days per week, based on business needs.
Employees will be required to come onsite on those days when they are involved in activities that they or their leader feel are better conducted in person.
