Job Description

What You’ll Do :

Reporting to the COO & CFO, the role of Corporate Counsel Disability Claims will work closely with the Director, Claims Management Operations and be responsible for managing a caseload of long-term disability claims, providing legal advice and representation of OTIP, while collaborating with internal stakeholders to ensure compliance with legal requirements.

The core parts of your role will be to :

Manage litigated long-term disability files from inception to resolution which includes but is not limited to filing a defense;

setting up mediations / discoveries; obtaining pertinent medical information, etc. to successfully close the action.

  • Provide legal advice / expertise as it relates to long-term disability claims.
  • Represent OTIP on litigated claims, in mediation, court hearings and trials related to disability claims.
  • Prepare and draft legal documents, including demand letters, settlement agreements, and court filings.
  • Stay informed about changes in legislation and case law related to disability insurance and ensure compliance with legal requirements.
  • Collaborate with internal teams, including disability analysts to develop strategies for resolving disability claims efficiently and effectively.
  • Maintain accurate and detailed records of file activity and communications with clients and external parties.

Accountabilities

  • Review new file assignments and draft initial pleadings.
  • Prepare for and attend case conferences, arbitrations, discoveries, motions, mediations, pre-trials and trials.
  • Monitor and review new laws, regulations, and case law; identify and summarize relevant issues.
  • Proactively provide advice and counsel to the Group Life and Disability Claims department.
  • Draft and / or review routine correspondence and communications.
  • Understand the goals and objectives of OTIP.
  • Assess business processes / practices and determine if they need to be modified and work with the team to implement applicable change(s).

Qualifications

This is the unique blend of skills and experience we would love to see in an ideal candidate :

  • LL.B. or J.D. degree from an accredited law school.
  • Member in good standing with the Law Society of Ontario.
  • 10+ years’ experience with Group Long Term Disability Claims, preferably defense.
  • Strong knowledge of Ontario disability law, including relevant statutes, regulations, and case law.
  • Strong analytical abilities and problem-solving skills, excellent judgement, with the ability to effectively evaluate complex legal issues.
  • Exceptional communication and negotiation skills, with the ability to advocate persuasively.
  • Ability to work independently and collaboratively in a fast-paced environment.
  • Attention to detail and strong organizational skills, with the ability to manage multiple tasks and deadlines effectively.
  • Excellent technical, drafting, reporting, and research skills.
  • Exercises discretion and maintains confidentiality of sensitive information.

Working Conditions :

  • A general office environment / hybrid work arrangement.
  • Travel may be required.
