Metrolinx is connecting communities across the Greater Golden Horseshoe. Metrolinx operates GO Transit and UP Express, as well as the PRESTO fare payment system.

Reporting to the Senior Manager, Business Ethics, Workplace Investigations & Restoration, the Workplace Investigations Manager receives, triages, investigates and addresses complex incidents and / or complaints of misconduct and workplace harassment and discrimination received by the Metrolinx’s Workplace Harassment and Discrimination Prevention Team under Employee & Labour Relations.

This role will provide expertise, and policy and program management in the areas of human rights, business ethics, and workplace conduct.

They will liaise with key partners and business groups on highly sensitive, complex employee relations and human rights workplace matters, leveraging a solid understanding and expertise in the Ontario , the , the , and related laws, when assessing workplace concerns and identifying appropriate resolution strategies, including conducting fair, thorough, impartial, and timely investigations.

The Workplace Investigations Manager will also be expected to conduct mediations as required and to support workplace restoration efforts. What will I be doing?

  • Lead the resolution of complex and confidential workplace misconduct and human rights complaints, including alleged violations of Metrolinx’s Code of Conduct and Ethical Business Policy, Workplace Harassment and Discrimination Prevention Policy, Conflict of Interest Policy, and related corporate policies and relevant legislation by conducting impartial investigations.
  • Intake, triage, and identify appropriate resolution options for a diverse range of employee concerns relating to workplace misconduct, harassment, discrimination, and other alleged violations of Metrolinx’s business ethics and conduct policies and legislation.
  • Conduct multifaceted misconduct and human rights investigations from receipt of complaint to resolution by managing intake;

triage; complainant, respondent, and witness interviews; investigation report writing with high quality, well-reasoned investigation reports, and recommendations to prevent reoccurrence.

  • Exercise a variety of skills, including critical thinking, data analysis, rigorous research methods, advanced investigative techniques and time management processes to ensure investigations are thorough, impartial, well-supported and timely.
  • Provide subject matter expertise and consultation to management and employees on their rights and responsibilities with respect to ethics and human rights corporate policies and related legislative requirements.
  • Conduct workplace assessments and systemic reviews, as required.
  • Engage in early resolution of complaints and lead mediation, facilitated discussions, and other alternative dispute resolution techniques as appropriate.
  • Lead the tracking and monitoring of complaints, and prepares in-depth trend analysis, and data reporting for strategic program planning.
  • Review Metrolinx’s ethics and human rights corporate policies including the Workplace Harassment and Discrimination Prevention Policy and Procedures and the Code of Conduct and Ethical Behaviour Policy for continuous improvement.
  • Develop and delivers respectful workplace, ethics and workplace harassment and discrimination prevention training and presentations to various stakeholders to help build awareness and promote respectful and safe work environments.
  • Stay abreast of legal, legislative, and administrative developments in employment and human rights law to provide compliance-related advice.

Stays abreast of recent case law developments and makes recommendations for applicability to Metrolinx.

  • As a subject matter expert, work with cross functional teams, advisory committees, and stakeholders to progress workplace respectful conduct policy and program related projects and initiatives, manages distribution of information, provides updates and seeks feedback to achieve desired outcomes.
  • Work with external vendors, when necessary, and ensures timeliness, procedural fairness, regular status updates, cost effectiveness and a quality work product.
  • Collect and use statistical information and metrics (i.e. indicators, trends, reports and / or data) to identify quality improvement initiatives under Metrolinx’s workplace harassment and discrimination policies, processes and program.
  • Contribute to development of policies, frameworks, reporting tools, resources, procedures, and program implementation to identify improved methods / techniques related to workplace harassment, discrimination and misconduct complaint investigation, prevention, and workplace restoration to promote safe and respectful working environments.

What Skills and Qualifications Do I Need?

  • Completion of a degree in Law, Human Rights, Labour Relations or Human Resources, or related field. Advanced degree preferred or a combination of education, investigation and ADR training and experience deemed equivalent.
  • Demonstrated progressive experience in relevant positions such as Workplace Investigator in Human Rights, Ethics and Conduct or other related workplace investigative positions, with progressive experience in conducting workplace investigations under the Ontario and the and experience in alternative dispute resolution (i.

e. mediation, conciliation) techniques.

  • LL.B. / JD and CHRP certification are assets.
  • In-depth knowledge and demonstrated ability to interpret and apply human rights, employment and workplace safety related legislation (i.

e. the Ontario , the ), combined with strong knowledge of equity and diversity principles and jurisprudence related to human rights and inclusion issues.

  • Experience in conducting complex human rights and workplace misconduct investigations, including in a unionized environment and with a public sector employer governed by the
  • Knowledge, involvement, and familiarity with the history of and barriers faced by racialized, Indigenous, and Black communities due to racism and anti-Black racism issues of equity and systemic change.
  • Extensive interviewing, investigative and research skills, report writing and presentation skills.
  • Superior written communication skills to conduct investigations and provide reports, briefings, and memoranda.
  • Experience identifying client needs, and initiating, coordinating, and implementing solutions in response to client issues.
  • Excellent judgement and objectivity supported by strong analytical, problem solving and case management skills.
  • Experience in developing and delivering employee training programs on workplace ethics, conduct and human rights.
  • Experience in alternative dispute resolution (conciliation / mediation / negotiation) techniques.
  • Active listening skills to understand the full extent of issues, analyze, and resolve issues.
  • Excellent organizational skills, agile and demonstrated ability to multi-task and prioritize effectively in a fast paced environment.
  • Proficiency in computer applications, including MS Office (e.g. Outlook, Word, Excel, PowerPoint)
