Experienced Wills and Estates Clerk
Position Overview :
Our client, a reputable mid-sized law firm located in downtown Toronto, is seeking a highly skilled and experienced Wills and Estates Clerk to join their team. The ideal candidate will have 7-15 years of hands-on experience in managing all aspects of estate planning, administration, and litigation support. This position requires expertise in drafting wills, administering estates, managing trusts, and preparing necessary legal documentation for probate and related matters.
Key Responsibilities :
- Drafting and Preparing Legal Documents : Prepare wills, powers of attorney, and other estate planning documents. Ensure that these documents are accurate and comply with legal requirements.
- Probate and Estate Administration : Manage the probate process, including preparing and filing probate applications, letters of administration, and estate inventories. Handle asset valuations and distributions in accordance with the decedent’s will or applicable laws.
- Trusts : Administer testamentary and family trusts, including preparing and filing trust documents, managing trust assets, and ensuring compliance with trust provisions.
- Tax Compliance : Prepare and file estate tax returns and ensure compliance with applicable tax laws. Work with clients and tax professionals to manage tax liabilities.
- Estate Litigation Support : Assist in the preparation of documents for contested estates, including will challenges and probate disputes. Draft affidavits, motions, and other litigation documents.
- Debt Settlement : Assist with settling estate debts and handling creditor claims, including drafting notices to creditors and ensuring timely payment of debts.
- Corporate Estates : Provide support for corporate estate administration, including managing shares, company valuations, and business succession planning.
- Client and Stakeholder Communication : Act as the primary point of contact for clients, beneficiaries, executors, and other stakeholders. Communicate effectively to keep all parties informed on estate progress.
- Document Management and Filing : Manage and maintain estate files, ensuring proper organization and compliance with firm policies. Handle physical and digital filing of documents, including court filings related to probate matters.
- Legal Research : Conduct legal research on relevant estate and tax law issues to support ongoing estate administration and litigation matters.
