Job Overview
- The company has a requirement to establish a warranty, claims and dispute management program for the purpose of administering warranty items across the enterprise.
- The candidate will be required to develop the program and processes from inception to close.
- This program, as a minimum, will tie heavily to Operations, Asset Management, Contract Management and Risk Management organizations.
- The candidate will be required to apply contract provisions to support Operations during equipment and system failures, including the assertion of warranty provisions of contracts, managing disputes between suppliers and the company as it relates to open claims.
- Elements of the program will include building out reporting mechanisms for senior leadership, as well as participating in the technology modernization initiative to ensure that business needs are identified for a successful warranty, claims and dispute management program.
- A thorough understanding of enterprise asset management, including its relationship to other system integrations is required for this role.
- There will be a heavy reliance on the ability for the candidate to read, interpret and apply contract provisions, including drafting Defective Work Notices, preparation of financial impacts to the organization as it relates to settlement of disputes, drafting settlement agreements etc.
Qualifications
- Degree in Law, Paralegal, Certified Contract Management Professional or other similar program
- Must have 10 to 15 years of experience administering disputes and claims.
- Must have extensive knowledge and application with the Ontario Construction Act
- Excellent written and verbal communications skills, with the ability to work at all levels of the organization
- Excellent presentation skills
- Superior understanding and application of Supply Chain and Contract Management preferably in a large construction-based organization. Government experience in energy or transportation is considered an asset.
- Must be a self-starter
