The expected starting base salary for this position is $135,311 – $149,885 annually, depending on a variety of factors including qualifications and experience. Once hired, you will progress through a wider salary range over time as you continue to develop job knowledge, skills and competencies for the role.

What you’ll be doing

Reporting to the Chief Legal Officer (CLO), the Corporate Legal Counsel (CLC) provides legal support to ensure the effective, efficient, and fair management of legal matters within the purview of the College, and in accordance with the Health Professions Act (HPA), Health Professions and Occupations Act (HPOA), the Freedom of Information and Privacy Protection Act (FOIPPA), the Privacy Act, the Personal Information Protection and Electronic Documents Act (PIPEDA), College bylaws, and administrative law. The CLC also provides corporate and governance legal support to BC College of Nurses and Midwives’ (BCCNM) Board, Registrar/CEO, committees, and staff, as appropriate, on policies, and processes. The CLC also provides legal advice and guidance related to staff’s application and understanding of the HPA, HPOA, FOIPPA, and administrative law.

Your key responsibilities include:

  1. Under the direction of Chief Legal Officer (CLO), provides legal research and support regarding College bylaws: identifies and documents legal issues within current bylaws; assesses, drafts, and recommends changes to College bylaws and internal policies and procedures; and supports the ongoing efficient and effective management of the College, and best practice and compliance with administrative law.
  2. In consultation with CLO, and working with management across the organization, analyzes, develops, and evaluates a corporate wide approach to assessing and determining legal issues related to regulatory decision making; ensures approaches, policies and processes reflect a legally sound, defensible outcome, ensuring consistency in decision making and an appropriate level of regulatory oversight to ensure public protection.
  3. In consultation with CLO, develops College and Board governance and corporate policy; ensures alignment with the Health Professional Act, Health Professions and Occupations Act, and College bylaws.
  4. Under the direction of the CLO, provides legal advice and support to statutory decisions makers including the Registrar, Capacity Officer, Support Officer and Support Programs Administrator on statutory decisions.
  5. Under the direction of the CLO, provides legal support to committees of the Board.
  6. Supports contracting: manages contract templates; drafts non-standard contracts; provides legal oversight of contracts; responds to management and staff questions related to contracts, and ensures staff follow protocols related to contract development, implementation and record keeping.
  7. Performs risk assessments, monitors legislative changes, and ensures that data sharing agreements and contracts are properly executed.
  8. Assists the Operations team with updating insurance policies, responding to claims on the policies, and logging reporting on financial exposure to claims.
  9. Drafts correspondence to applicants, registrants, complainants, and third-party organizations such as legal counsel, HPRB, and Employers, as required.
  10. Provides legal support and information to staff, committee members, and as appropriate, registrants and the public.

Your education & skills

  • Bachelor of Law Degree or Juris Doctor required. Must be a practicing member of the Law Society of B.C.
  • 5 to 7 years of experience in a regulatory setting or a law firm working in the areas of administrative law and professional regulation is required.
  • Experience advising statutory decision makers, and drafting decisions required.
  • Experience advising on the implementation of administrative penalty programs, alternative resolution programs or support programs and applying statutory eligibility criteria related to those programs required.
  • Experience drafting bylaws and policy frameworks to support statutory decision-makers required.
  • Excellent oral, written and interpersonal communication skills. Ability to use audience appropriate communication and language to present information and convey concepts that are confidential, complex, and sensitive in nature.
  • Strong organizational skills, experience in managing a high volume of work, and the ability to handle diverse situations as they arise.
  • Ability to work within several statutory frameworks and apply relevant legal principles to diverse issues.
  • Ability to exercise good judgment in recognizing scope of authority and protecting confidential information.
  • Ability to establish and maintain professional relationships with registrants, colleagues, external partners, and the public.
  • Ability to manage an independent workload while contributing effectively to the team.
  • Intermediate to advanced skills with current MS Office systems is required.
  • Experience with MS CRM Dynamics and MS SharePoint an asset.
  • Knowledge of the Health Professions Act, Health Professions and Occupations Act, FOIPPA legislation, PIPEDA and the Privacy Act is an asset.
  • Knowledge of Canadian colonial impacts on Indigenous people in social and health contexts, including social, economic, political, and historical realities impacting Indigenous communities and knowledge of Indigenous-specific anti-racism and accompanying reports (e.g. The Truth & Reconciliation Commission’s 94 Calls to Action (2015), the In Plain Sight Report (2020), and Reclaiming Power and Place’s Calls for Justice (2019)) is an asset.
  • Demonstrated understanding of equity, diversity, inclusion, and cultural humility as they apply to health care is an asset.
